Description
Construction disputes carry significant risk for all owners, operators, contractors, suppliers, consultants, and insurers. Max Abrahamson wrote, "A party to a dispute… will learn three lessons (often too late): the importance of records, the importance of records, and the importance of records." Claims and disputes are common. However legal fees and arbitration/litigation costs involved in pursuing claims can put businesses under immense financial strain. This is particularly true when records are unclear or onerous to work with. Where evidence is unclear, the time and cost involved in resolving disputes can skyrocket. Over the past decade, HKA has helped clients use digital evidence to their advantage in dispute resolution. On this journey, we've developed an understanding of best practices for architecture, engineering, and construction projects. In this session, we'll cover how to produce useful evidence using models (and Autodesk software), and we'll discuss case studies showing best practices.
Key Learnings
- Discover how models can be used as factual contemporaneous evidence using case studies.
- Discover how software can support analysis/claims (e.g., clash detection, viewpoints, quantification, change analysis).
- Discover how claims can be supported using CDE records, and the legal issues regarding disclosure/access.
